These Terms of Service apply to the use of the Harlequin Candles website and the purchase of products from Harlequin Candles.
Throughout these Terms, “we”, “us” and “our” refer to Harlequin Candles. By accessing this website or purchasing from us, you agree to these Terms of Service together with any other policies referred to on this website.
Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services to you.
1. Australian Consumer Law
Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Your rights under the Australian Consumer Law apply in addition to any rights provided under our Refund Policy.
Consumer guarantees apply automatically to products purchased from Australian businesses and cannot be removed by store policies or terms and conditions.

Because many Harlequin Candles products are handmade in small batches, there may be minor variations in colour, texture, finish or appearance between individual items. These variations are a natural part of handmade production and do not affect your rights under the Australian Consumer Law.
Colours may also appear slightly different depending on your device or screen settings.
We may change or discontinue products, fragrances, packaging or product availability from time to time.
Products may also be available in limited quantities.

We aim to keep product descriptions, pricing, availability and other information on this website accurate and up to date.
Occasionally, information may contain an error or omission. Where this occurs, we may correct the information as soon as reasonably possible.
If an error affects an order you have already placed, we will contact you where appropriate.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
5. Prices
All prices displayed on our website are in Australian dollars unless otherwise stated.
Prices may change without notice.
A price change will not affect an order that has already been accepted by us, except where there has been an obvious pricing or technical error and applicable law permits us to correct it.

6. Orders

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

If an order is delayed, missing or damaged during delivery, please contact us and we will assist where we reasonably can.
Your rights regarding damaged, faulty or undelivered goods are not affected by this section.
9. Returns, Refunds and Consumer Guarantees
Our change-of-mind and returns arrangements are explained in our Refund Policy.
We do not offer refunds or exchanges simply because you change your mind unless we choose to do so.
This does not affect your rights under the Australian Consumer Law.
If a product has a major problem, you may be entitled to choose a refund or replacement. Where a problem is minor, we may be entitled to provide another appropriate remedy in accordance with the Australian Consumer Law.
10. Handmade Products
Harlequin Candles products are made and finished in small batches.
Minor differences between products may occur, including variations in:
- colour
- texture
- surface appearance
- fragrance colour
- handmade vessel finish
- placement of labels or decorative elements
These characteristics do not necessarily indicate a fault.
However, this section does not exclude any right you may have where a product fails to meet a consumer guarantee under the Australian Consumer Law.
11. Candle and Product Safety
Customers are responsible for following any safety instructions, warning labels and care instructions provided with our products or displayed on our website.
Candles should always be used in accordance with the supplied candle-care instructions, including appropriate wick trimming, maximum burn times and safe placement.
Reed diffusers, room mists, wax melts, car fresheners and other fragrance products should also be used only as directed.
Nothing in this section removes any responsibility we may have under applicable law for supplying safe products.

We are not responsible for the content, security, privacy practices or availability of third-party websites that we do not control.
